Terms of Service

These Terms of Service govern all yacht charter and sea transfer services provided by Roko Nautika d.o.o. (trading as Maro Charter), OIB: 39838966704, Ribarska 1a, 51000 Rijeka, Croatia. By submitting a booking inquiry or signing a charter agreement, you accept these terms.
1. Definitions
- "Maro Charter" — Roko Nautika d.o.o., OIB: 39838966704, Ribarska 1a, 51000 Rijeka, Croatia — operator of yacht charter and sea transfer services from Marina Novi Vinodolski.
- "Client" — an individual or group entering into a charter agreement or requesting a transfer service.
- "Charter" — the hire of a sailing yacht or motor yacht for a specified period — bareboat (sailing at your own responsibility, subject to presenting a valid boating license and VHF certificate) or skippered (with a professional skipper provided by Maro Charter).
- "Transfer" — a point-to-point sea transport service using our patrol or fast vessels.
- "Booking Confirmation" — the written charter agreement (Charter Party) and accompanying invoice issued by Maro Charter upon receipt of the deposit.
2. Booking and Confirmation
All bookings are subject to availability. A booking becomes binding only upon receipt of the signed charter agreement and deposit payment. An inquiry alone does not constitute a binding booking. Charters typically begin and end on Saturdays; standard durations are 1, 2, or 3 weeks.
- A 30% deposit is required to confirm your booking.
- The remaining balance is due no later than 30 days before the charter start date.
- Late payment may result in automatic cancellation without deposit refund.
- Bookings made within 30 days of departure require full payment at the time of booking.
3. Cancellation Policy

Cancellations must be submitted in writing to info@marocharter.com. We strongly recommend comprehensive travel insurance covering charter cancellation. Under the Croatian Consumer Protection Act (OG 19/22), the statutory 14-day right of withdrawal does not apply to charter contracts with agreed dates (Art. 79(1)(l) of the CPA).
4. Cancellation by Maro Charter
Maro Charter reserves the right to cancel or terminate a charter or transfer under the following circumstances:
- Adverse weather conditions posing a genuine safety risk (e.g. bura at 7+ Beaufort, jugo with high swell)
- Mechanical breakdown or vessel damage requiring repair before or during the charter
- Force majeure events (pandemic, port closure, state of war) beyond our reasonable control
- Non-payment of the remaining balance by the agreed deadline
In the event of cancellation by Maro Charter due to weather conditions or mechanical breakdown, we will offer a full rebooking or a complete refund of all amounts paid. We are not liable for consequential costs such as flights, accommodation, or other travel arrangements.
5. Licenses and Documentation
Under the Regulation on Conditions and Methods of Navigation (OG 137/21 and amendments), at least one person aboard must hold a valid boating license and VHF certificate. For bareboat charter:
- Copies of all licenses must be provided to Maro Charter before booking confirmation.
- Original license documents must be on board for the entire duration of the voyage.
- The mandatory crew list is prepared by Maro Charter at check-in based on submitted passport details.
- Any crew changes during the voyage must be reported immediately; a new crew list is issued.
- Clients who do not hold valid licenses must book a skippered charter.
- Maro Charter accepts no responsibility for fines, vessel detentions, or costs arising from the client's failure to carry valid documentation.
6. Conduct on Board
The captain (provided by Maro Charter or the client themselves) has absolute authority over the vessel and the safety of all persons aboard. Maro Charter reserves the right to terminate the charter without refund in cases where conduct endangers the vessel or crew.
7. Liability and Insurance
All Maro Charter vessels are insured in accordance with Croatian law, including third-party liability and passenger liability. However:
- Maro Charter is not liable for personal injury or property loss caused by the negligence of the client or guests.
- We are not liable for delays or losses caused by weather conditions, harbor authority decisions, or force majeure.
- We advise clients to independently arrange comprehensive personal travel, health, and baggage insurance.
- Our total liability shall not exceed the total charter fee paid for the affected period.
8. What's Included
Unless otherwise stated in the Booking Confirmation, all charters include:
- The vessel as specified, equipped and maintained to Croatian Maritime Office standards
- Bed linen and towels
- Basic safety equipment (life jackets, distress flares, fire extinguisher, first aid kit)
- Skippered charter: a professional skipper for the duration of the charter
- A comprehensive pre-departure briefing on the vessel, safety equipment, and route
- 24/7 sea assistance coverage via our Highfield Patrol 760 RIB
The following are not included unless expressly stated in the Booking Confirmation:
- Fuel (settled at the end of the charter based on actual consumption)
- Marina fees and charges
- National park entrance tickets (e.g. Kornati)
- Food, drinks, and provisioning
- Fishing and diving permits
9. Sea Transfer Services
Transfer bookings are subject to the same deposit and cancellation conditions as charters. Additionally:
- Quoted prices are per transfer, not per person, unless expressly stated otherwise.
- Luggage is limited to one soft bag per passenger; bulky items must be declared in advance.
- Departure times are estimates and may be affected by sea conditions or harbor traffic.
- Maro Charter is not liable for missed flights, ferries, or onward connections due to delays.
10. Governing Law
These Terms of Service are governed by the laws of the Republic of Croatia. All disputes arising from or in connection with these terms are subject to the exclusive jurisdiction of the competent court in Rijeka, Croatia. EU consumers have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
